On this the fourth day of October 1839
personally appeared before Lyman Lawson, Judge of the Court of Probate for [and] County of Oxford
Mary Horton
A resident of Brookfield in the County of Oxford and State or District of Maine, aged seventy seven years, who being first duly sworn according to law, doth on oath make the following declaration, in order to obtain the benefit of the provisions made by the Act of Congress, passed July 7th, 1838, entitled "An Act granting half pay and pensions to certain widows." That she is the widow of Barnabas Horton who was a soldier in the Revolutionary War for which service he received a Pension from the United States under the [?] of the Act of Congress of March 18th 1818, the [participation] of which service I and [?] able to state, but refer to the evidence on file in the Pension office in my said husbands case for evidence in support of this application-
She further declares, that she was married to the said Barnabas Horton on the day of is the year seventeen hundred and eighty four and that her husband, the aforesaid Barnabas Horton died on the fourth day of February 1835, that she was not married to him prior to his leaving the service, but the marriage took place previous to the first of January, seventeen hundred and ninety-four, vix; at the time above stated

Oxford 33. I the subscriber Register of the Court of Probate in & for said County hereby certify that Lyman Rawson before whom the foregoing proceedings were had as Judge of the Court of Probate aforesaid.
I also certify that the witness contains the originals for [?] of said Judge in the matter of the application of Mary Horton for a Pension.
I also further certify that Samuel F. Brown, before whom the [?] affidavit was made oath to, was and now is a Justice of the Peace in & for said County duly qualified. In testimony where of I have set my hand and the seal of said Court the fifth day of November 1839.

I Daniel Thompson of Bushfield, in the County of Oxford & State of Maine, testify and say that I came well acquainted with Mary Horton, now residing in said Brookfield, and know her to be the widow of Barnabas Horton, late of Bridgewater, in Massachusetts, deceased, with whom I to [was] well acquainted. I was not present at the death of said Barnabas, but I knew from various other circumstances, that he is dead, & that the died fourteen years ago, having married his daughter & his widow, the said Mary, having lived in my family since [?] decade of said Barnabas.

I Henry Thayer of Winchester in the County of Cheshire of New Hampshire Justice of Lawful age do testify and Say that Barnibas Horton that marries Molly Morse did live in in the house with me. Something like three years man & wife with said Molly Henry Thayer
Cheshire ss on the twenty nineth of August
AD 1839 came before me Henry Thayer & made oath the the above deposition by him subscribed is true before me Amos Boly justice of the Peace
I Philena Thayer of Winchester in the County of Cheshire & State of New Hampshire of lawful age do testify * say that I attended the marriage of Barnabus Horton to Molly Morse they were lawfully Maried by the minister of the town. phlene Thayer
Cheshire ss on the twentynineth day of August AD 1839 came before me Philine Thayer & made oath that the above deposition by her [?] is true before me Amos Baly Justice of the Peace.
I here testify that the above named Henry Thayer & Philene Thayer are both of good more Charactors and Credible witnesses
